In 2005 and 2007 the California State Legislature passed bills granting gays and lesbians the right to marry, undercutting the right-wing claim that gay marriage is something "activist judges" foist onto an unwilling public. The majority on the state's Supreme Court, weren't "legislating from the bench"; they were reaffirming legislative will.

As the nation's most populous state, California often sets in motion social and political trends that sweep across the country. But legal experts on both sides of the fight over same-sex marriage say that the California Supreme Court's ruling giving gays and lesbians a right to marry is not likely to have a ripple effect.
